Welcome to HintGo! These Terms and Conditions ("Terms") govern your access to and use of HintGo's services, including our survey platform (app.hintgo.ai), website (hintgo.ai), blog, communications, and any associated tools and features (collectively referred to as the "Services").

Definitions

Customer. Individuals who sign up for HintGo to create surveys and gather responses from their audience.

Respondent. Individuals who answer surveys created by Customers.

Notice to Respondents

If you are a Respondent to a survey created by one of our Customers, the Customer controls the information collected through the survey, including your responses, any associated metadata, and any identifying information they may have linked to the survey. HintGo does not control how Customers manage or use this information.

For questions about your information or how it is collected and used, contact the Customer who created the survey and invited you to participate. They are responsible for determining the purposes and methods of processing your data.

Acceptance

By accessing or using our Services, you ("Customer" or "Respondent") agree to comply with these Terms. You are also required to read and accept our Privacy Policy.

By continuing to access or use our Services, you confirm that you have read, understood, and agreed to be bound by both these Terms and our Privacy Policy. If you do not agree, you may not use our Services.

Service Description

HintGo offers an intelligent survey platform designed to help organizations gather valuable insights with ease. Our AI-powered system allows Customers to create adaptive surveys that adjust in real-time based on responses, ensuring you get the most relevant and actionable data.

Account Registration and Management

Customers must create an account to access HintGo's services. When creating your account, you are required to provide truthful and accurate information. You may not create an account if you are not authorized to do so, and you must not impersonate anyone else during the account creation process.

Customers are responsible for maintaining the confidentiality of their account credentials and all activities conducted under their account. To create an account, Customers must provide their:

  • Full name
  • Email address
  • Password
  • Valid credit card for billing purposes

Subscription. To use HintGo's survey platform, Customers must select a subscription plan and pay the applicable fees. Subscriptions operate on a monthly basis. Customers authorize HintGo to charge their selected payment method. Subscriptions may be updated based on usage. Customers will be notified when changes take effect.

Team. Teams allow multiple people to collaborate, simplifying survey and data management. Customers who wish to create a team may need to provide additional information about their role and organization. The account that creates the team is designated as the account owner unless otherwise changed.

Account Owners. Account owners are responsible for:

  • Monitoring billing information to ensure subscription fees are paid on time.
  • Maintaining a valid payment method for paying fees.
  • Monitoring usage and related fees.
  • Paying subscription fees by the due date.

Account owners can manage billing and subscriptions through their account settings or by contacting HintGo support.

Limitations. HintGo's websites and resources are intended to provide general information about our platform and services. They may not always be accurate, complete, or up-to-date and are not intended to provide legal or professional advice. Customers are encouraged to seek independent guidance for regulatory and legal compliance. Content and resources on HintGo's websites may be updated, varied, or discontinued at any time without prior notice.

By creating an account, accessing the platform, or using our Services, you explicitly agree to these Terms. All fees are non-refundable.

Acceptable Use Policy

Prohibited Activities. Customers and Respondents agree not to use HintGo for unlawful purposes, including but not limited to harassment, defamation, or the collection of sensitive data, such as Protected Health Information (PHI). Additionally, users must not interfere with the operation of the Services or engage in activities that may harm other Customers or compromise the platform's functionality.

Enforcement. HintGo reserves the right to suspend or terminate accounts that violate this policy. Such actions may include the removal of content, temporary account suspension, or permanent termination, depending on the severity of the violation. These measures are designed to ensure a safe and secure environment for all users.

Disclaimer of Warranties

HintGo provides its Services on an "as-is" and "as-available" basis, without any warranties of any kind, whether express or implied. While we strive to ensure the reliability and performance of the platform, HintGo does not guarantee uninterrupted, timely, or error-free operation of the Services. We make no warranties regarding the accuracy, completeness, or reliability of any content or results derived from the use of the platform.

Limitation of Liability

To the fullest extent permitted by law, HintGo is not liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of its Services, including but not limited to lost profits, loss of data, or business interruptions. HintGo's total liability for any claims under these Terms is strictly limited to the fees paid by the Customer in the 12 months preceding the incident giving rise to the claim. This limitation applies regardless of the nature of the claim, whether based on contract, tort, or other legal theories.

Notices, Governing Law, and Disputes

Notices. HintGo will send notices, alerts, and communications regarding the Services and these Terms electronically to the email address on file for the Account Owner. Account Owners can update their contact information in their account settings. Any notice you wish to provide to HintGo may be sent using the contact details available on our Contact Us page.

Governing Law. HintGo operates in Quebec, Canada. All matters related to access and use of the Services will be governed by the laws of the Province of Quebec, Canada, without regard to its conflict of laws principles.

Disputes. In the event of a dispute, both parties agree to resolve the matter through good-faith consultation and negotiation. If unresolved within 60 days, disputes will be resolved through binding arbitration before a single experienced arbitrator in Quebec, administered under applicable arbitration rules.

Electronic Communications. By agreeing to these Terms, you consent to receive all notices, agreements, and communications electronically via email, through the Services, or by email. Communications include updates to these Terms, transaction records, service-related notices, and customer support messages. All electronic communications will be considered "in writing." You are encouraged to print and retain copies of important communications for your records.

If you prefer not to receive communications electronically, you must close your account by contacting us. Withdrawal of consent will only be effective after all outstanding amounts owed are settled and a reasonable processing period has passed. Without consent for electronic communications, you cannot access or use HintGo's Services.

Changes to Terms

HintGo reserves the right to modify or update these Terms at any time. Customers will be notified of significant changes through email or within the platform. Changes will take effect immediately upon posting unless otherwise specified.

By continuing to access or use the Services after changes are implemented, you agree to be bound by the revised Terms. If you do not agree with the updated Terms, you must stop using the Services and may terminate your account by contacting HintGo support. We encourage you to review these Terms periodically to stay informed of any updates.
